The Lee Sheriff and other local law enforcement agencies have stepped up their investigation of prescription fraud with arrest soon to come. The new Drug Database is expected to produce many new arrests within the next ninety day. Investigations in doctor shopping seem to be the focus of this new drive. Although many of the people to be arrested are addicts, many of the new arrests will be of people who were obtaining Oxycontin, Zanax and other opiates to sell to recreational drug users.
For a small investment including the doctor's fee and a minimal payment to the pharmacy, drug dealers can make enormous profits reselling the pills to customers. The latest scheme is to send in multiple "patients" who procure the prescriptions for supposedly real injuries or illnesses and then resell them to the dealers for resale at a big profit. By using multiple patients, the dealers can escape and get around the new Drug Database requirements and keep their supply flowing.
As a Ft. Myers drug lawyer I have seen an increase in investigations and subpoenas to Doctors and pharmacies as the State builds its cases on suspected drug dealers. You can expect to see a number of drug trafficking cases coming down the pike within the next few months. These cases will carry harsh minimum mandatory penalties with long jail sentences for those that have the misfortune of being convicted. If you are under investigation, you do not qualify for the Public Defender. The Public defender is only appointed after you are arrested. If the police come to question you, contact me immediately. Do not give a statement or think you can talk your way out of being arrested. You have the right to remain silent. Do not turn over your scripts bottles or make any statement that will incriminate you further. You have a right to an attorney but before you are arrested you do not get the Public Defender. Call a criminal defense lawyer immediately upon contact by the police.
